Agreement to Terms

By downloading, installing, or using The Word Club ("the app," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

Description of Service

The Word Club is a vocabulary learning application that provides:

• A new vocabulary word delivered daily
• Word definitions and example sentences
• Learning progress tracking
• Familiarity feedback to help measure your vocabulary knowledge

The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

User Accounts

When you first use the app, an account is automatically created and linked to your device. You are responsible for:

• Maintaining the security of your device
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

Your account is tied to your device through Apple's secure device attestation. If you delete the app or switch devices, you may lose access to your learning history.

Acceptable Use

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble the app
• Interfere with or disrupt the app's servers or infrastructure
• Attempt to gain unauthorized access to any portion of the app or its systems
• Use automated scripts or bots to interact with the app
• Circumvent, disable, or otherwise interfere with security features
• Share or redistribute app content without authorization

Violation of these terms may result in immediate termination of your access to the service.

Intellectual Property

Our Content

The app, including its design, features, graphics, and code, is owned by The Word Club and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Word Definitions

Word definitions and examples are sourced from the Free Dictionary API (dictionaryapi.dev) and are used in accordance with their terms. These definitions are provided for educational purposes only.

Your Feedback

By providing feedback on words (such as indicating whether you knew a word), you grant us a non-exclusive, royalty-free license to use this aggregated, anonymized data to improve the service for all users.

Advertisements

The app displays advertisements provided by Google AdMob. By using the app, you acknowledge and agree that:

• Advertisements will be shown during your use of the app
• Google may collect certain data for advertising purposes as described in our Privacy Policy
• You may limit ad tracking through your device's privacy settings
• We are not responsible for the content of third-party advertisements

Privacy

Your use of the app is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the app, you consent to our data practices as described in the Privacy Policy.

Disclaimers

We do not warrant that:

• The app will be uninterrupted, timely, secure, or error-free
• The definitions or examples will be completely accurate
• Any errors in the app will be corrected
• The app will meet your specific learning requirements or expectations

Limitation of Liability

To the maximum extent permitted by law, The Word Club and its developers, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the app
• Any content or conduct of third parties, including advertisers

Our total liability for any claims arising from or related to these terms or your use of the app shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $10 USD, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless The Word Club and its developers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the app
• Your violation of these Terms of Service
• Your violation of any rights of another party

Termination

We may terminate or suspend your access to the app at any time, without prior notice, for any reason, including if we believe you have violated these terms.

You may terminate your account at any time by:

1. Opening Settings in the app (gear icon)
2. Tapping "Delete My Account and Data"
3. Confirming your decision

Upon termination, your right to use the app will immediately cease, and your data will be deleted in accordance with our Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes:

• The "Last Updated" date will be revised
• We will notify you through the app or App Store update notes
• Your continued use of the app after changes constitutes acceptance of the new terms

If you do not agree to the modified terms, you should stop using the app and delete your account.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the app shall be resolved in the courts located in the United States.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and The Word Club regarding your use of the app and supersede any prior agreements.
